In the first instance please contact the Management if any issues are encountered.
We recommend all guests purchase travel insurance since Management is not responsible for any injuries, illness or accidents that may occur whilst staying at our Property.
“Booking” means the period for which you have paid to stay at the Property.
“Property” means ‘studio33 com’ (Address: 33 Rosetta Terrace, Port Elliot. South Australia. 5212) and all it’s fixtures, fittings, contents and equipment.
“Management” means the owners and managers of the Property.
"Guests" mean the persons who are Booked to stay overnight in the Property during the Booking.
"Visitor" means a person a Guest permits to visit the Property during the Booking.
“Full Amount” means the summation of the assigned tariff (Extras and Specials applied) for the desired dates of stay, the Security Bond, the cleaning fee and the linen charge (if linen is requested).
2. ACCEPTANCE & RESPONSIBILITY
Payment of the Deposit constitutes acceptance of these Terms and Conditions.
3. CHECK IN/ OUT
Check-in time is not before 2 pm on the arrival date.
Check-out time is not later than 12 pm on departure date. Late check-out is subject to prior arrangement and availability ONLY and extra charges will apply. When Guests fail to adhere to this condition a late departure fee of 50% of the equivalent of the security bond will apply.
In checking themselves out of the Property Guests must ensure the Property is left as described below and that all windows, shutters, gates and doors are secured and/or locked.
The key collection procedure is as arranged upon payment of the Full Amount.
On departure the keys must be returned as per key collection.
One set of keys will be provided to the guest.
Replacement of the key while the Guest is occupying the building will incur a charge.
Replacement of the key after the Guest has vacated the Property will incur a charge and may incur an additional charge should Management deem the lock needs replacing.
Payment is as per Terms and Conditions of 'airbnb'.
5. CANCELLATION OR VARIATION?
If Guests wish to vary or cancel their Booking they are required to log in to 'airbnb' and make their changes in accordance with 'airbnb' Terms and Conditions for Booking variation or cancellations.
Should Guests be eligible for a refund it will be made through the 'airbnb' online payment system.
Management have a minimum nights stay policy of 2 nights with additional minimum nights stay restrictions (for detail please refer to Extra Detail for studi033 com on the 'airbnb' site).
No refund will be made for a variation to the extent that it breaches our minimum nights stay policy.
6. SECURITY BOND
A bond payment of $AUD 400 is required at the same time as the outstanding balance of Guest’s Booking. It will be credited to Guest’s designated payment method once the Property has been inspected and deemed left in the same state to the Guest’s arrival.
Management agrees to ensure this occurs within 7 working days of Guest’s departure.
Any damage, loss or expense incurred by Management as a result of Guest’s breach of these Terms and Conditions will be charged against the bond. Examples of this include but are not limited to any breakage, damage or excess cleaning requirements, inconvenience to Management or extra guests beyond those declared.
In the event that damage, loss or expense incurred by Management as a result of the Guest’s breach of these Terms and Conditions exceeds the bond amount of $AUD 400, the Guest, by agreeing to these Terms and Conditions, agrees to pay for any excess cost over and above the Security Bond that arises from their breech of these Terms and Conditions within 7 days of receipt of the invoice.
7. GUEST RESPONSIBILITIES
The property is let for holiday accommodation purposes only and is strictly not to be used for any other purpose including but not limited to commercial purposes, receptions, parties or functions.
Guests are not to use the property, or cause or permit the property to be used for any illegal purpose.
Guests are not to smoke or allow smoking to occur on the property with the exception of what can be defined as public footpath outside the external property boundary. Provisions (containers) have been made so as to discard cigarette butts at this location and are to be used and their contents discarded into a rubbish bag and then in a rubbish bin upon vacating the property.
All guests must conduct themselves in a proper manner so as not to cause a nuisance, including excessive noise, or interfere with the use or enjoyment of the Property for other occupiers or neighbouring properties. Unruly, loud or offensive behaviour will not be tolerated. If complaints are received this may result in termination of the booking, eviction and loss of unused balance of accommodation.
No more than the registered number of Guests are to occupy the Property. Additionally it is against SA Department of Health regulations for more persons to occupy the Property than there are beds to accommodate them. No extra mattresses (including swags/bed rolls/sleeping mats) are to be bought onto the Property for the purpose of accommodating extra Visitors. If the Property is reported or found to be overloaded or more occupants than booked, the Booking will be terminated and guests will be asked to vacate, with no refund.
Only the Guests nominated and agreed in the Booking may stay in the Property over night.
Strictly no tents or caravans are permitted on the property.
No pets are to be brought within the property boundary (including car parking area).
It is the Guests responsibility to maintain the cleanliness of the property during the lease period.
Guests are responsible for keeping the property secure during their stay and will be responsible for any theft or damage due to neglect in this area.
Guests accept full responsibility for any breakages, loss or damage caused to the Property caused by them directly or indirectly, or by another occupant or by a Visitor invited on or in the Property by the Guest during the tenancy and, agrees to authorise the Management to pay for any such breakages, loss, damage and all forms of cleaning (including but not limited to rubbish removal) of the property by deduction of the applicable amount from the Security Bond to a maximum of $400.00. Where the Security Bond is not sufficient to cover the cost of any such breakages, loss, damage and all forms of cleaning (including but not limited to rubbish removal) the Guest, in agreeing to these Terms and Conditions, agrees to pay for any excess cost over and above the Security Bond that arises from their breech of these Terms and Conditions.
The Property is furnished to the owners taste and style and accepts no responsibility for any unmet expectations of the Guest in respect of any design, quality or other aspect of the Property.
The Guest is responsible to the Management of the Property for any act or omission by any person the Guest allows on the Property who breaches any term or condition contained in this agreement.
Departing Guests are responsible with leaving the Property clean and tidy. This includes washing, drying and putting away all dishes, emptying the dishwasher, emptying and cleaning of the refrigerator, oven/griller and microwave, cleaning of the bbq, leaving the beds neatly folded back, turning off all the lights and cooling/heating appliances, removing all waste from bins, cleaning waste bins, removing waste from property. If the dishes are not washed, dried and put away, the dishwasher not emptied and/or the bbq or the oven has not been cleaned (as found), the waste hasn’t been removed an automatic Security Bond deduction applies of $45.00 per item to be completed.
Please note that Management has an arrangement with Dodd and Page (Port Elliot Office- located on the corner of The Strand and Port Elliot Road) for Guest’s waste disposal. During occupancy and upon departure, Guests are required either to dispose their waste in the skip at the rear of the Dodd and Page Office (found in the car park) or take it with them.
If Guests use all of the hot water during the day it will need to re-heat overnight. Constant hot water supply is not available. The water heater, while of large water capacity, supplies both the Property and the adjoining residence. It is therefore requested that showers be kept to a maximum of 5 minutes duration. In the event of running out of hot water, the grey coloured metre box can be found at the Northern end of the brush fence (portion facing the road/reserve) of the adjoining property. Within the metre box the ‘boost’ button needs to be depressed for approximately 4 seconds (seen on LCD display) until an audible ‘click’ is heard. Hot water will be available in approximately 2 hours.
If a plumber is sent without this action been take, payment of the plumbers account will be deducted from the Security Bond.
Linen must be used on all beds.
For each bed occupied; 1 bottom sheet, 1 top sheet and a pillow cover is required.
LINEN (sheets, pillow cases, towels, bath mats and tea towels) IS NOT INCLUDED unless arranged with Management.
The opportunity to hire Linen through Management is at time of Booking.
If linen has been hired all the linen at the time of departure needs to be placed in the bag provided and left outside the Property for collection by Victor Linen service.
Pets are not permitted at the Property including in the car parking area.
If a pet is reported to be on or in any part of the the Property an automatic Security Bond deduction of $150.00 applies over and above any service that needs to be rendered as a result of the presence of a pet (including hair removal/pest control) and the Guest tenancy will be terminated with no refund made.
If the Property becomes unavailable for Guest occupancy due to unforeseen circumstances (eg. fire, storm, damage, etc) then Management will inform the Guest immediately and endeavour to obtain suitable alternative accommodation for their occupancy; failing which any moneys paid will be refunded in full.
The Property is rented on a fully self-contained basis.
Guests must inform Management immediately any damage or breakage to the Property and its contents by phoning Management on (phone number hidden).
Guests must inform Management immediately by phoning (phone number hidden) upon arrival if the Property is not clean, otherwise they are deemed to have accepted the property in its given condition. If a Property is reported as dirty, Management reserves the right to inspect and have the Property cleaned as soon as possible.
In the event of faults and/or malfunctions of appliances or inclusions, there is no obligation from Management to compensate or discount.
Management will accept no responsibility for any inconvenience with machinery breakdown. The Management will best endeavour to repair, replace or hire the item at fault.
Should a tradesperson be sent out at a Guest’s request to carry out a repair that was unnecessary, the cost for the callout will be at the Guest’s expense.
Left items- if requested we will endeavor to recover and return items inadvertently left on the Property, but we take no responsibility for the recovery or return of these items. A minimum cost of $60.00 incl GST before postage cost applies and is at Guest’s expense. Left items will be held by Management for a maximum of 2 months and if not claimed will be donated to the local opportunity shop.
Management may inspect the property with reasonable notice and at any time or without notice if there is any belief that there has been a breach of these conditions.
The Guest agrees to let, use and occupy the Property at his or her own risk and hereby releases to the maximum extent permitted by law and the Management of the property from any injury, liability, debt, loss, cost, delay, expense however arising in the connection with the letting, use and occupancy of the Property including by breach of contract, duty or statue. Further the Guest shall indemnify the Management of the property against any claims made by any other person or entity in relation to the use and occupancy of the Property.
Management reserves the right to take appropriate remedial action and/or seek compensation for any serious beach of these Terms and Conditions of letting.
The Guest is aware Management will disclose their personal information in order to provide details to Management’s Landlord’s Insurance Company.
Management will not be held responsible if the property does not meet with Guest expectations after the booking has been confirmed.
Clause 7. Guest Responsibilities is an essential term of this agreement. If the Guest commits, causes of otherwise permits a breach of this Clause 3 or any other Clause contained within the Terms and Conditions during the tenancy, the Management is authorised to immediately terminate the tenancy and to retain all monies paid by the Guest under this Agreement.
