Rental application and lease
RENT: Your payment may be required up front and can be wired to Landlord’s bank account or deposited into Landlord’s Attorney Trust account as the lease sets out. Credit cards are accepted however a credit card usage fee of 2.75% per swipe with card present is charged and a fee of 3.5% + 15¢ per manually entered transactions. A return check fee of $30.00 will be charged for any returned checks
LOCK-OUTS: If you lock yourself out you may call (PHONE NUMBER HIDDEN) and arrangements will be made to get you a key or someone will come and unlock your unit. There will be a $25.00 charge during 8-5 hours and a $50.00 charge if after hours. If landlord is not available, you are responsible for paying a locksmith to get into your unit. Tenant agrees to pay $150.00 for relocking fee if at any time during tenancy keys are lost or stolen or if all keys are not returned at end of lease. Landlord keeps a lock box on the door and you will have the code so you should have access to the property if you lose or misplace your key.
NOISE AND DAMAGES: Residents are not allowed to make any noise in their unit that is disturbing to the other residents. Residents are responsible for the behavior of any and all guests in their unit, regardless of whether or not resident is present. You are responsible for the cost of any damages your guests may do to the building. To control noises, tenants are to keep down the volume of music and broadcast programs at all time so as not to disturb other neighbor’s peace and quiet. WHO TO CALL: If you are disturbed by another tenant’s noise, your first call should be to the neighbor or knock on their door, the second call to the Tempe. Police (ph(PHONE NUMBER HIDDEN) or (PHONE NUMBER HIDDEN), as they have the power to handle the immediate problem. Your third call could then be to the manager, Mark Mershon (phone #: (PHONE NUMBER HIDDEN)) so he can follow up.
BIKES: There are bike racks at the condo unit you can use. No bikes to be stored outside nor attached to railings. If you have bikes and store them in the unit; please keep them on the tile and in the patio area. There is no bike locks on the porch area but the condo association does allow bikes to be stored there at your own risk.
STORAGE: There is no room provided for storage of boats, trailers, campers, or any extra vehicles. You get a covered spo(URL HIDDEN)13 and an uncovered spot # 147. There is room for visitation parking at the north end of the complex.
TOILETS: Please Do not use Charmin TP. Do not place disposable diapers, tampons or wipes in the toilet. A plunger is in your unit, try it first. Any damage or plumbing charges resulting from such action will be charged to the tenant.
REPORTING DAMAGES: Any damage or needed repairs are to be reported immediately. ALTERATIONS: None allowed.
ILLEGAL ACTIVITY: No firearms or weapons are allowed on the premises with permission of landlord. Any illegal or criminal conduct or activity against other occupants in the building or co-tenants shall be grounds for immediate termination of your tenancy.
WINDOWS, DOORS & SCREENS: Tenants are responsible for any broken glass and damaged screening in the dwelling unit regardless of fault while Tenant occupies the premises. Any damages are to be immediately reported to the Landlord.
NO SMOKING and NO PETS: All condos units and common areas shall be non-smoking. There shall be no smoking of any kind in any part of the unit. If you smoke in the patio all cigarette butts shall be disposed of in proper receptacles. Smoking in the unit is subject to a $300.00 fine. Violation of any No Pet policy by tenant or tenant's guests will subject the tenant to forfeiture of their security deposit as liquidated damages.
ACKNOWLEDGMENT OF OPERATING DETECTORS AND RECEIPT OF TESTING AND MAINTENANCE INFORMATION. Tenant hereby acknowledges and affirms that the smoke detectors have been installed in the rental unit per City Code. Tenant acknowledges that all the detectors are operating on the date on which Tenant moves in.
HOLD HARMLESS: Tenant agrees to indemnify and hold harmless Landlord and Manager from and on account of any and all damage to property or personal injury by fire, theft or accident to any person(s), or to the merchandise of property of any person(s) arising from the failure of Tenant to keep the Premises in good condition as herein provided, or rising from the negligence of an Co-Tenant and/or his/her guest or by an owner or occupant of adjoining or contiguous apartments. Tenant’s agreement to indemnify and hold harmless shall include costs and attorney fees incurred by Landlord on account of any such damage or injury described above. Tenant agrees to pay for all damages or injuries to Landlord or other resident, their guest and families caused by the Tenant or his/her family or guests, whether by negligence or misuse of the Building property or its facilities or otherwise.
THE UNDERSIGNED HAVE READ AND UNDERSTAND THE ABOVE LISTED RULES AND ACCEPT THEM AS AN INTEGRAL PART OF THE LEASE. And understand that the rules may be amended or other rules adopted concerning the tenant’s use and occupancy of the premises, at the discretion of the Landlord. Tenant has been provided with a copy of the condo rules for the pool and workout facility and agrees to abide by them. Tenant agrees to be bound by said rules and understands that should he/she violate these rules, then Landlord would have sufficient grounds for the termination of Tenant’s lease.
