Affordable, pet friendly, Oceanside home with hot tub

Dancing gull is a 4 bedroom, 2.5 bath home located on the Oceanside of HWY 12 in beautiful Waves, NC. We have a fully stocked kitchen, dining for 10, pool table, 50 inch tv with cable channels, and a large hot tub. We are a pet friendly home(125.00 fee covers 2 house trained dogs). The ocean is just a short 5 minute walk away. Come and stay with us, we would love for you to be our guest!!

House is a Sunday turnover during the months of May thru September.


Note to 2020 travelers(Covid19)- We have purchased additional house sanitizing above and beyond our normal check out cleaning procedures. We have also removed all “non essential” items from the home at this time(blankets, pillows, books, decor) we are implementing these temporary changes to keep our guests as safe as possible. The house surfaces will be sanitized multiple times before your arrival.

SHORT TERM RENTAL AGREEMENT
This Short Term Rental Agreement (the “Agreement”) is made by and between William and Amber Weeks (“Homeowner”) and (“Guest”) as of the date last set forth when the payment is made and the box is checked during the payment process agreeing to terms and conditions of this agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

1. Property. The property is located at: Waves, NC exact address provided after booking

The property is furnished and includes appliances and other household items. Linens are not provided.
2.Rental Party: The rental party shall consist of Guest and the following persons: Guest will have a maximum of adults and children as requested in the original VRBO/Homeaway/Air BnB request: (The guest may have additional family members stay at the house during the week and will notify the owner in advance.)
3. Maximum Occupancy: Guest make take possession and maintain possession of subject property for the full lease period. The guest shall not permit the property to be occupied or used as a residence by more than 10 people. This includes the guest, family (including all children) and guests.
4. Term of the Lease. The lease begins at 6:00p.m. on ____________ (the “Check-in Date”) and ends at 10:00 a.m. on ________________ (the “Checkout Date”).
5. Minimum Stay: This property requires a 7 days/night minimum stay.
6. Rental Rules: Guest agrees to abide by the House Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property.
7. Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.
8. Rental Rate and Fees
As provided in a quote in VRBO/Homeaway/AirBnb reservation process. The deposit is for security and shall be refunded within 7 days of the check out date provided no deductions are made to: I. Damage to the property or furnishings; II Dirt or other mess requiring excessive cleaning or III Any other cost incurred by homeowner due to guests stay.
If the premises appear dirty or damaged upon Check-in, Guest shall inform the Homeowner immediately.
9. Cancellation Policy: In the event guest cancels reservation of the leased property and said property is not re-rented during the entire terms set out above: then all rent consideration previously tendered will be forfeited by guest and retained by owner. All cancellations must be in writing. 10. Hurricane/Storm policy: No refunds will be given, we highly recommend you purchase travel insurance of your choice.
11. Travel Insurance: We highly recommend you purchase travel insurance. If you wish to purchase travel insurance, go to the link below for detail and to purchase.

12. Limitation of remedies, damages and indemnity: In the event the owner is unable to deliver said property to guest under this lease agreement because of fire, damages, imminent domain or act of nature, or if the property is unavailable because of delay in construction, or because of lack of water or sewer, or otherwise unfit or uninhabitable or for any other reason whatsoever, guests hereby agrees that owners sole liability as a result of any of these conditions is the full refund of all consideration previously tendered by guest pursuant to the terms of this lease, and guest expressly acknowledges that in no event shall owner be held liable for any consequential or secondary damages, including but not limited to any expenses incurred as a result of moving, for any damage, destruction or loss. Guest also agrees that in the case of a double booking or occupancy by owner, guest will be entitled to a full refund of all consideration previously tendered by guest. The guest and their family members, guests and/or other occupants of the vacation home agrees to release and indemnify the owner from and against all claims for damages and/or personal injuries to any person arising out of the use of subject premises, including interior and all exterior areas, including decks, stairs and other common areas that occurred during the tenancy of the premises. These claims include those that allegedly may fall under the vacation rental act. Guest also agrees to defend owner and his agents from any lawsuit alleging damages and/or personal injury that occurred during the guests rental at the property. Guest shall not be entitled to any refund due to unfavorable weather, maintenance problems, area construction, early departure, or disruption of utility services (including cable and internet) after occupancy. Guest agrees to be responsible for any repairs necessary due to their negligence. Owner reserves the right to enter and inspect premises with a reasonable notice to guest. In the event of an ordered evacuation due to hurricanes or other storms, guest is required by state law to evacuate property.
13. Payment: Acceptable payment methods are [e-check or credit card]. VRBO/AirBnB payment system is being used and a link will be sent via email in order to pay online.
14. IN WITNESS THEREOF, this agreement is executed in two counterparts with an executed counterpart being retained by each party hereto. NOTICE, this is a legally binding contract. (A) This agreement shall be governed by and interpreted in accordance with the law of the state of NC.
(B) This agreement shall be treated as though it were executed in the county of Dare, state of NC, and were to have been performed in the county of Dare, state of NC. Any action relating to this agreement shall only be instituted and prosecuted in court in NC. Guest specifically consents to such jurisdiction and to extraterritorial service of process.
I have read this entire lease agreement and will comply with all its terms. Specifically, I understand and will comply with house rules in exhibit A.

HOUSE RULES- EXHIBIT (A)

A. Property will be left clean, free of any damages, and essentially in the same condition found at the start of the rental period. The security deposit will be returned to the guest within 7 days of the end of the rental period, less any amount due for damage repairs and excessive cleaning.
We will certainly appreciate your consideration and cooperation to ensure so that no future guests will be disappointed in the level of cleanliness when they arrive. We have amble cleaning equipment and supplies for this purpose.
1. All floors including carpets, hard wood floors, and bathroom floors must be left clean. If there are any spill spots, please clean them with a damp rag.
2. Remove all food from refrigerator and wipe it down if any mess remains. Please leave the items that are labeled “Dancing Gull” in the refrigerator.
3. Please put kitchen equipment back where it belongs so that the next guests will have an easy time finding what they need. There is an inventory list in the drawer where everything goes, and there are also individual lists on each cabinet door. Wash all dishes in dishwasher and put dishes away. Clean sink and wipe down countertop.
4. Please run washer with rags, kitchen towels, and bath mats that you used and run them in the dryer when clean.
5. Smoking is absolutely NOT ALLOWED inside the house. If you or any of your party chooses to smoke on the deck or outside, please use an empty soda can or bottle for cigarette butt disposal. We have no way to police the area outside the house and clean up the butts. Please do not bury them in the sand!
6. Please take all garbage out and leave in container in front of the house.
B. Pets are permitted only with prior approval and the pet addendum must be completed.
C. Accommodations: Guest is responsible for keeping the house and property clean and safe during the entire tenancy. In addition, guest is responsible for any and all damage to the house and/or property during the tenancy excluding act of nature or cause by third party. Due to health department regulations, occupancy on homes served by septic systems is limited to two persons per bedroom. In addition, parking is also limited. Please do not over occupy. Please respect owners locked closets. These are not included in your rental of the property.
D. Check-In is at 4:00pm. While all effort is made to have any repairs handled prior to your arrival in the event that such repairs are still being completed when you arrive you will be allowed to unpack your belongings and put your food in the refrigerator.
E. Check-Out: Since our cleaner/inspector must come at 10am, guest are expected to be out of the house by that time. Leasee is responsible for washing dishes, taking out trash, emptying refrigerator, leaving the AC set on 78 degrees (or heat set on 60 degrees in the winter months), securing all doors and windows, and leaving the house clean, damage free and in good shape for the next renter.
F. Damages: We ask our guest to report any breakage or damages to us upon occurrence and settle the matter before they leave. If there is any damage done to the house or property, the leasee does agree to be responsible for any damages done by himself, his family, guests, pets, or vehicles. Guest authorizes owner to charge his security deposit for such damages and acknowledges in writing same to guest. Guest agrees to pay for any damage in excess of his security deposit. Guest are not permitted to move furniture within the unit nor burn candles. Smoking is not allowed in the house. If smoking outdoors, please do no liter the property with cigarette butts.

G. Grilling: A gas grill is available on the upper deck. Please be extremely careful using the gas grill as it gets quite windy at times. You are responsible for any damages caused by outdoor grill. Please turn off the tank valve after each use. A charcoal grill is also available downstairs. Do not use the charcoal grill on the deck. Please be sure to clean the grill before you leave so the next guest finds it ready for use. Fireworks are not permitted on the premises at any time.
H. Hot Tub: A Hot Tub is being provided for your pleasure and soaking in Hot Tub is relaxing, warm and wonderful. But at the same time, hot water holds some potential dangers. Guest are permitted use of Hot Tub only with prior approval and as per the terms and conditions of the “Hot Tub Addendum”. Owner cannot be held liable for any injuries caused by improper use of Hot Tub.

I have read House Rules and will comply will all its terms above.

PET EXHIBIT (B)

It is hereby agreed by and between Homeowner and Guest that homeowner will allow guest to have the following described pet and no others in the vacation home upon and subject to the terms and conditions of the rental agreement and this addendum.
The permission granted herein shall be limited to a certain pet as described below:
Guest hereby agrees to comply the following:
Pets, 2 dogs maximum (house trained)
1. Guest to pay additional pet fee in the amount of $ 125.00 per week.
2. All pets must comply with the following specifications (documentation from an accredited veterinarian must be provided by Guest upon request): a. May not exceed 80 lbs. b. Must be at least 2 year(s) of age or older. c. Must be spayed or neutered. d. Must be up-to-date on rabies vaccinations and all other vaccinations. Heartworm preventive is highly recommended.
3. All pets must be leashed at all times. Please be aware that there are a number of feral/ stray cats in the area. 4. Guest is responsible for cleaning up any/all pet refuse. 5. Pets are not allowed on furniture at any time. Any evidence of pets on furniture may incur extra cleaning fees. 6. All pets are to be treated with a topical flea and tick repellent three (3) days prior to arrival. Fleas and ticks are very rampant in this area and can cause harmful/fatal illness to humans and pets. 7. Pet must not cause damage to premises or furnishings. If damages are caused, the cost of the damage may be deducted from security deposit. 8. Guest should prevent pets from producing excessive noise at a level that disturbs neighbors. 9. Pet will not be left unattended for an undue length of time, either indoors or out. Pet will not be left unattended on balcony, patio, or porch. 10. Homeowner assumes no responsibility for illness or injury that may incur to pets or humans while on the premises.
The Guest shall be solely responsible for the pet while on the property.
I have read this Pet Addendum agreement and will comply with all its terms above.

Hot Tub Rules – EXHIBIT (C)

It is hereby agreed that Homeowner allows Guest to use the Hot Tub subject to the terms and conditions of the rental agreement and this addendum.
*Never use the spa or hot tub when you're alone.
*Persons with heart disease, diabetes, high or low blood pressure or any serious illness, and pregnant women-indeed persons with any doubt-should not enter a spa or hot tub without prior consultation with their doctor.
*Before entering, look at the water in your spa or hot tub. If there is cloudiness or foaming, or if a "locker room" or strong chlorine smell is present, the water needs treatment. Soaking in such water greatly increases your chances of getting a skin rash (pseudomonas). Be sure to maintain the water properly. Ask your spa or hot tub professional for guidance.
*People with skin, ear, genital or other body infections, open sores or wounds should not use the spa or hot tub because of the possibility of spreading infection.
*Shower with soap and water before and after using the spa or hot tub. Showering before use washes away many of the common skin bacteria, and removes lotions, deodorants, creams, etc. Perspiration and lotions will reduce the effectiveness of the disinfectant and lesson the ability of the filter to work efficiently.
*High water temperatures can elevate your body temperature of your internal organs beyond safe limits. (It's almost like having a fever.) It is recommended that maximum water temperature never exceed 104 degrees Fahrenheit (40 degrees Celsius).
*Soaking too long makes some people nauseous, dizzy, lightheaded or faint. Don't soak for more than 15 minutes at one sitting in 104 degrees Fahrenheit (40 degrees Celsius) water. If you wish to soak for a longer period of time in high temperatures, leave the spa or hot tub after 15 minutes, shower, cool down and then return for another brief stay. In lower temperatures (e.g., 98.6 degrees - normal body temperature), most people can comfortably and safely soak for longer periods at one sitting. If you have any questions about what's right for you and your family, consult with your doctor.
*Never use hot tub while or after using alcohol. Alcohol acts to expand your blood vessels and increase your body temperature- much like soaking in hot water does. Alcohol in your bloodstream and soaking at the same time creates a combined effect that can be damaging. The body temperature may accelerate to dangerous levels quickly. The alcohol may cause nausea, dizziness or lightheadedness. The ultimate danger of combined alcohol consumption and hot water soaking is drowning due to loss of consciousness, heart attack or injury due to passing out and falling.
*As with alcohol, the combined use of certain prescribed medicines and hot water soaking can be dangerous. Never use a spa or hot tub while or after using narcotics or other drugs that may cause sleepiness, drowsiness or raise or lower blood pressure. With any drug or medication, consult with your doctor about potential harmful effects from combined use of the drug and hot water soaking. Never use a spa or hot tub if you are under the influence of drugs.
*Do not try to adjust or touch equipment such as pumps, heaters or electrical appliances while you are in the spa or hot tub, or while standing in water, unless designed as such and recommended by the manufacturer.
*Enter the spa or hot tub slowly and cautiously. Be careful of your footing, and allow your body to gradually get used to the water temperature. Leave slowly as well, because your leg muscles may be sufficiently relaxed to make you a bit unsteady, and you may become lightheaded.
*Never allow children to use the spa or hot tub unsupervised. Children enjoy playing in water and may not understand the risk involved in too much exposure. Discretion is advised in allowing children to use spas and hot tubs at all, since their young bodies may not adjust well to the high temperatures. If in doubt, check with your doctor.
*If young children will be using your spa or hot tub, explain to them that they cannot under any circumstances dive or jump into it. While a spa or hot tub may seem large and deep to a child, it is not designed for jumping, diving or underwater swimming.
