CHECK-IN TIME is AFTER 3 P.M. CST AND
CHECKOUT is 10 A.M. CST. NO Early Check-in or late checkout. Fees will be incurred if there is early check in or late check out.

This is a NON SMOKING unit. Any guest discovered to be smoking inside unit will immediately forfeit security deposit. Only smoking outside in front porch is permitted. Please dispose of butts in garbage can.


EXCEPTION FOR SPECIAL EVENTS and Holidays
Christmas, New Years, Super Bowl, Mardi Gras, French Quarter Fest, Jazz Fest, Labor Day, Memorial Day, St. Patrick’s Day, Essence Fest, July 4th, Halloween, VooDoo Fest, etc.)- FULL PAYMENT REQUIRED AT TIME OF BOOKING.

CANCELLATIONS –
CANCELLATIONS - A sixty (60) day notice is required for cancellation. Cancellations that are made more than sixty (60) days prior to the arrival date will incur no penalty. Cancellations or changes that result in a shortened stay, that are made within sixty (60) days of the arrival date, forfeit 50% of the advance payment/reservation deposit. Cancellations made within thirty (30) days of arrival date forfeit all of the advance payment/reservation deposit. Cancellation or early departure does not warrant any refund of rent. EXCEPTION FOR SPECIAL EVENTS/Holidays-Christmas, New Years, Super Bowl, Mardi Gras, French Quarter Fest, Jazz Fest, July 4th, St. Patrick’s Day, Essence Fest, VooDoo Fest, Halloween, Labor Day, Memorial Day, etc.)-LIMITED or NO CANCELLATION REFUNDS-Only if unit gets re-rented.

DAMAGE DEPOSIT – A $600 damage deposit is required. The deposit is NOT applied toward rent; however, it is fully refundable within (14) days of departure, provided the following provisions are met.
•No damage is done to unit or its contents, beyond normal wear and tear.
•No unauthorized or extra guests.
•No Damage to Hot Tub Spa and/or Cover.
•No charges are incurred due to contraband, pets or collection of rents or services rendered during the stay.
•All debris, rubbish and discards are placed in dumpster, and soiled dishes are placed in the dishwasher and cleaned.
•All charges accrued during the stay are paid prior to departure.
•No linens are lost or damaged. No remotes missing.
•No early check-in or late checkout without permission.
•The renter is not evicted by the owner (or representative of the owner), the local law enforcement, or the security company employed by My Community.
•All keys are returned- (Loss of 1 key forfeits security deposit).


MAXIMUM OCCUPANCY – The maximum number of guests staying overnight is limited to eight (8) persons. Additional guests only allowed at discretion of owner. An additional charge of $50.00 per person per night for any guests staying overnight in addition to the agreed number of guests will be assessed. (may be less than 8). No additional overnight guests allowed without permission of owner. Any additional undisclosed guests discovered to be staying will be cause for immediate eviction of all guests forfeiting all remaining fees including security deposit. No refunds for guests that do not arrive.

MINIMUM STAY – This property requires a two (2) night minimum stay on Fridays and Saturdays. One night stays are allowed Sun-Thursday. Longer minimum stays may be required during holiday/special events periods.

INCLUSIVE FEES – Rates include a one-time linen & towel setup. Amenity fees are included in the rental rate.

NO DAILY HOUSEKEEPING SERVICE –
While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. However, it is available at an additional rate. Extra pool towels are provided on patio.

RATE CHANGES – Rates subject to change without notice.

FALSIFIED RESERVATIONS – Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check in.


WRITTEN EXCEPTIONS – Any exceptions to the above mentioned policies must be approved in writing in advance.

Pool/Spa/Hot Tub – All renters are required to sign the Pool/Spa Agreement before taking occupancy. No children under the age of 10 permitted in hot tubs at any time. When using the hot tub, remember there is a certain health risk associated with this facility. Use at your own risk. Our housekeepers drain, sanitize, refill and replenish chemicals in all tubs prior to your arrival; therefore, it may not be warm until later that evening. DO NOT STAND OR SIT ON THE HOT TUB COVERS. Hot tub covers are for insulation purposes and are not designed to support a person or persons. They will break and you will be charged for replacement. Remember when not using the hot tub, leave cover on so hot tub will stay hot.

Please- No loud music outside after 11pm. Respect the neighbors!

Please-No glass outside. Use plastic glasses provided.


PETS -
PETS under 30 lbs. are permitted in rental units only with prior approval and signed pet addendum. $75 per pet fee applies. All pets must be leashed at all times. PETS MUST BE CONFINED TO FENCED FRONT YARD ONLY. Pet owners are responsible for cleaning up any/all pet refuse. Pets are not allowed on furniture at any time. Any evidence of pets on furniture may incur extra cleaning fees. All pets must be up-to-date on rabies vaccinations and all other vaccinations. Heartworm prevention is highly recommended. All pets are to be treated with Advantage or similar topical flea and tick repellent three (3) days prior to arrival. Pets must be on a flea prevention medication. Fleas and ticks are very rampant in this area and can cause harmful/fatal illness to humans and pets. All items above are the sole responsibility of the pet owner. The apartment owners assume no responsibility for illness or injury that humans or pets may incur while on the premises.


STORM POLICY–
•HURRICANE OR STORM POLICY – No refunds will be given unless:
•The state or local authorities order mandatory evacuations in a "Tropical Storm/Hurricane Warning area" and/or
•A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest.
•The day that the authorities order a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund:
•Any unused portion of rent from a guest currently registered;
•Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten the stay, to come in after the Hurricane Warning is lifted; and
•Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period.

All of the units are privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. There may be deductions in security deposit refund for rules not obeyed.

Bicycle Use Agreement and Waiver:

I, ____________________________________, acknowledge that by using any bicycles from DRF Enterprise, I become responsible for it. I understand that if the bicycle or other equipment is damaged or stolen while in my possession, I will be held accountable for the replacement/repair cost of: $250.00 – Bike, $10.00 – Bike Lock, $20.00 – Bike Helmet.
I understand the intended use of this bike is for fitness and transportation. Misuse of this bike may result in damage to the bike and/or may cause harm to myself. I understand that I must inspect the bike that I plan to use and report any damage prior to bike use. I also understand that for the safety of others, I am required to report any damage that may have occurred during the time that the bike is in my possession.
I acknowledge that using a bicycle has inherent risk and I assume all risk for using the checked out equipment. Bicycle helmets are not required by law, but are highly recommended, and I understand that I assume any additional risk if not wearing one.

SWIMMING POOL and SPA USE RELEASE AND INDEMNITY AGREEMENT

This Release and Indemnity Agreement (hereinafter referred to as the “Agreement”) is executed on the date below by Dan Fribush (president-DRF Enterprise LLC) “owner” of property located at 800 Louisiana Avenue, New Orleans, LA 70115 and

_____________________________ (tenant).

Tenant understands that Owners have a swimming pool/Spa at 800 Louisiana Avenue. Whereas, Owners have enclosed the pool/Spa with a fence/door (inclusive of a locked security gate and door) and provided Tenant with a key to locked door thereby allowing Tenant and Tenant’s family members and Tenant’s guests to use the swimming pool/Spa as approved by Owners and in accordance with this agreement, Tenant makes the following representations and agrees to abide by the following rules:

1.Tenant acknowledges that a swimming pool/Spa is hazardous to those persons who have not been trained to swim or whose condition renders them unable to swim capably, and that a fence/door (inclusive of a locked security gate) has been placed around the swimming pool/Spa in order to prevent such persons from having access to the swimming pool/Spa.
2.Tenant is responsible for keeping rear door locked at all times when not using the swimming pool/Spa; and Tenant is responsible for controlling access to the pool/spa area.
3.It is Tenant’s responsibility to insure that neither Tenant, Tenant’s family members nor Tenant’s guests will tamper with the lock on the security gate/door, prop the gate/door open, or take any other actions which would allow free access to the swimming pool/Spa by any person.
4.Tenant will not cause gate/door key to be duplicated or allow anyone else to duplicate gate/door key.
5.Tenant, Tenant’s family members and Tenant’s guests are allowed to use the swimming pool/Spa at any time when Owners are on/off premises except, when on infrequent occasion; the curtain across Tenant’s rear French doors may be temporarily drawn closed. At such time Tenant is temporarily restricted to front yard use only. (maybe happens once in a while usually late at night or for 10 mins in afternoon)
6.Minors are permitted to use the pool/Spa only when accompanied by an adult 18 years old or older. An adult (18 years or older) must be physically in the swimming pool/Spa with children under 6 years of age.
In consideration of being permitted to use the swimming pool/Spa, Tenant agrees to release, waive, discharge, and covenant not to sue Owner for all or any loss, claim, expense, or liability (including attorney’s fees and court costs), related to any bodily injury that Tenant, Tenant’s family members or Tenant’s guests may suffer, out of any property loss or damage that Tenant, Tenant’s family members or Tenant’s guests might incur, and/or out of Tenant’s death or death of any of Tenant’s family members or Tenant’s guests, which arises in whole or part, directly or indirectly, out of the use by Tenant, Tenant’s family members or Tenant’s guests of the swimming pool/Spa, whether the injury, damage, or death is caused by the negligence of Owner or otherwise. This release is intended to include all claims for damages, including actual monetary loss and payments, mental anguish damages, including suffering damages, damages for loss of consortium, and exemplary or punitive damages.

In consideration of being permitted to use the swimming pool/Spa, Tenant agrees to indemnify and hold harmless Owner from all loss, liability, damage and cost (including attorney’s fees and court costs) he may incur or that may be incurred by any other person as a result of Tenant’s use or the use of Tenant’s family members or Tenant’s guests of the swimming pool/Spa, or as a result of Tenant’s failure to comply with this Agreement, and to defend such person(s) with attorneys approved by them against any such loss, expense or claim, at Tenant’s sole cost and expense. This agreement of indemnity shall apply whether or not the loss, liability, damage, or cost is founded in whole or in part upon the actual or alleged negligence of Owner. Tenant assumes full responsibility for any risk of bodily injury, death and property damage, suffered by Tenant or by any other person, due to the negligence of Owner arising out of or caused by Tenant’s use or the use by Tenant’s family members or Tenant’s guests of the swimming pool/Spa and arising out of or caused by Tenant’s failure, or the failure of any family members or guests of Tenant’s to comply with this Agreement.

Tenant executes this Agreement on behalf of himself, and on behalf of his estate, heirs, executors, administrators, and assigns. This Agreement is intended for the benefit of Owner and his respective directors, officers, shareholders, members, employees, agents, parents, spouses, subsidiaries, successors, and assigns. Tenant, expressly agrees that this Agreement is intended to be as broad and inclusive as permitted by the laws of the State of Louisiana and that, if any portion of this Agreement is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

Tenant has carefully read this Agreement. Tenant knows the contents of this Agreement, and Tenant signs this Agreement as his own free act.

Bicycle Use Agreement and Waiver:

I, ____________________________________, acknowledge that by using any bicycles from DRF Enterprise, I become responsible for it. I understand that if the bicycle or other equipment is damaged or stolen while in my possession, I will be held accountable for the replacement/repair cost of: $250.00 – Bike, $10.00 – Bike Lock, $20.00 – Bike Helmet.
I understand the intended use of this bike is for fitness and transportation. Misuse of this bike may result in damage to the bike and/or may cause harm to myself. I understand that I must inspect the bike that I plan to use and report any damage prior to bike use. I also understand that for the safety of others, I am required to report any damage that may have occurred during the time that the bike is in my possession.
I acknowledge that using a bicycle has inherent risk and I assume all risk for using the checked out equipment. Bicycle helmets are not required by law, but are highly recommended, and I understand that I assume any additional risk if not wearing one.

Dan is a great host. Backyard was amazing and made the stay all that much better. When we checked in, Dan sat down with us and let us know of all the hot spots in town to go to and really helped us get a sense of what the city is all about. Couldn't have asked for a better place to stay. Would 1000% recommend

Five of us had a very comfortable stay. Close to shops and restaurants of Magazine St. It was great to have the pool.

Just wrapped up an excellent long weekend with a group of 8 guys for a bachelor party. We loved our stay at Dan's place. The back area was amazingly relaxing: taking a dunk in the pool to cool off from the New Orleans heat was clutch. The house was cool, clean and charming. Dan was a welcoming host filled with great recommendations -- the first floor is entirely private with its own door and Dan was never too invasive. The house is walking distance to a bunch of great bars and restaurants in a safe part of town. This was my 5th time in New Orleans -- I've stayed in some hotels in the Central Business District and some spots in the French Quarter -- but we were looking to get out of the hubbub for a more relaxing housing set-up that was still in the heart of a lot of action and this exceeded our expectations. Lyft/Uber is so cheap in NOLA, so getting anywhere you'd like to go will be a breeze! We'll definitely be back!

Awesome place to stay, with all the amenities one could ask for. The location is in a residential area and from there you can go just about anywhere you want to go. A very relaxing stay, quiet and peaceful. Look forward to our next visit.

Dan's place was great! We were there for a bachelorette party, and we comfortably slept 7 girls. The pool and hot tub were fabulous to lounge at and Magazine Street was so close! Tons of good restaurants, bars, and boutiques. The location was great because it was far enough away from the filth of Bourbon Street, but only about a $10 Uber ride to the French Quarter if that's where you wanted to be. The place was incredibly clean and stocked with a ton of amenities! Would definitely recommend to anyone with a group coming to stay in NOLA, but not wanting to be right on Bourbon.

Our stay was wonderful! Dave's place had very convenient parking, a great brunch spot across the street, as well as all of the shops and restaurants on Magazine street were only a short walk away. The pool and hot tub were great amenities. The hot water was endless and the pillows were comfy, which is what I look for in a stay away from home.
