I. HOUSE AND GROUND RULES
1. All residents are required to register with the Resident Manager within 72 hours of moving in. The Resident Manager will use the registration information & email address to issue decals for your mail box and vehicles. The Resident Manager will take this opportunity to explain the House Rules of The Moorings and answer any questions you may have to ensure that your transition to your new residence is made as smooth and convenient as possible.
2. It is the responsibility of the resident to register any guests and guest vehicles with the Resident Manager if the guests’ visit will extend beyond 72 hours. Residents are responsible for the conduct of their guests.
3. All apartments shall be used only for residential purposes. No apartment shall be used to carry on any trade or business with foot traffic and/or a retail trade. Home Offices are allowed. Residents are not allowed to store on any common elements such as the grounds, recreational areas, or parking areas any items except that bicycles may be kept in bicycle houses, kayaks may be stored in kayak racks and all scooters and toys must be kept in privacy areas when The Moorings Common Area lighting is lit. Any exceptions to this paragraph must be granted by the Resident Manager in writing.
4. Each apartment occupant shall keep his privacy areas (in front and back) and dock in a neat and attractive condition at all times as determined by the Board of Directors.
5. All commonly owned items including furniture, furnishings, trees, plants or equipment of The Moorings shall not be converted permanently to any individual resident’s use.
6. Unless otherwise provided in the Declaration and/or approved by the Board of Directors, residents are not allowed to erect or place in the project any building or structure including:
a. Fences;
b. Air Conditioners protruding outside the louvers in the front two bedrooms;
c. Steps;
d. Walls;
e. Boat Docks;
f. Additions or alterations of any kind;
g. Lanai enclosures;
h. Signs;
i. Posters and Bills whatsoever.
EXCEPTIONS:
For garage/lanai sales, the Board will allow a maximum of 4 signs within the Moorings for a maximum of two (2) days. It is the responsibility of the resident to remove the signs after the two-day sale.
One (1) decal displaying “Security Systems Installed” will be allowed to be posted in your front and rear lanai area.
One (1) door knocker or doorbell may be affixed to your gate.

7. No resident shall decorate or landscape any common area or any other portion of the project, except in accordance with standards established by the Board of Directors of The Moorings and with specific plans approved in writing by the Board of Directors.
8. All residents and guests shall avoid making noises and using defective mufflers, musical instruments, radios, televisions, and amplifiers in such a manner as may disturb other residents. While this rule shall have general application at all times, 10:00 P.M. to 8:00 A.M. has been designated as the “hours of quiet” Sunday through Thursday and 11 PM to 8 AM on Fridays, Saturdays and Evenings before all State and Federal holidays This rule will be strictly enforced during those times.
9. No items such as garments, rugs, or other objects shall be hung from the windows, lanais or walls of the project. In addition, such items shall not be dusted or shaken from the windows of the apartments or cleaned by beating on the walkways. There shall be no clothes lines or racks on any exposed lanai. No refuse, garbage or trash of any kind shall be thrown, placed or kept on any common elements or limited common elements of the project outside of the metal container provided for such purpose.
10. BULK ITEMS. Bulk/oversized items that do not fit into the dumpster may be stored in the #1 dumpster area until the monthly BULK Pickup service is available. Bulk pickup for our area is usually the fourth (4th) Wednesday of each month. BULK items should be brought to the curb on the evening of the 4th TUESDAY or before 6 am Wed. morning, the day of pickup. It is the responsibility of the RESIDENT to carry their bulk items to the curb. Check with the Resident Manager for any changes to the City and County BULK pickup program dates.
11. No items shall be allowed in an apartment or common element which would overload or impair the floors, walls or roof. These items include plants, trees and roots of courtyard trees.
12. Without the written approval of the Board of Directors, no resident shall install any wiring for electrical or telephone installation, machines or air conditioning units, sky vents, solar panels, skylights, or other equipment apparatus whatsoever on the exterior of the project or protruding through the walls, windows or roof thereof. Any approved apparatus (as above) must be BLACK in color to match the roof or painted to match the walls.
13. Throwing any debris, rocks or other material into the Marina is prohibited.
14. Climbing or walking on any walls (private or common) is Prohibited.
15. No fireworks are permitted in the complex. (Deleted conditions allowing fireworks)
16. The “SPEED LIMIT” within The Moorings is FIVE (5) MILES PER HOUR for all vehicles including bicycles and scooters which can only he ridden in the streets of The Moorings. It is absolutely imperative that this speed limit be observed by everyone to ensure the SAFETY of all residents within The Moorings.
17. Bicycles and scooters without lights shall not be ridden in the complex in low light conditions. (When the Common Area lights are lit).
18. Feeding or watering ducks on The Moorings property or from docks is prohibited.
19. Holiday lighting and decorations shall not be installed earlier than 30 days before and shall be removed no later than 30 days after the holiday. If the holiday or decorative lighting becomes objectionable to neighbors, then the said lighting may

need to be removed, reduced or curtailed at the sole discretion and judgment of the BOD. Holiday lighting can be defined as any strings of lights colored or clear, or individual lights that are used to decorate rather than provide area lighting. All common and limited common elements such as yards, grounds, landscaping, parking lots/stalls, slopes, and marina access areas, etc., shall be used only for their respective purposes as designated in the Condominium File Plan, Horizontal Property Regime and House Rules. These areas will not be used for recreational activities. The Swimming Pool and Recreational Center areas are designated for recreational purposes and subject to a separate set of rules. (See House Rule IV, Pool and Recreation Center.)
20. STORM WARNINGS In the event of imminent storm warning, including high winds and flood conditions, all residents are required to remove all unattached items from the balconies, lanais and privacy areas (e.g. lanai furniture, umbrellas etc.). These items should be placed in a secure area.
21. WOOD DECK LANAIS as a general rule, wooden decks and lanais can be overstressed and are subject to breakage. Common sense should prevail.
22. There will be no use of common element electrical outlets without the Resident Manager's written approval.
23. Moorings power tools and equipment are for the exclusive use of Moorings staff. Lending or Borrowing Moorings power tools or equipment is prohibited.
II. HOUSEHOLD PET RULES
1. No livestock, poultry, or any other such animals whatsoever shall be allowed or kept in any part of the project.
2. Household pets such as dogs, cats & any other domestic animals approved by Board of Directors may be kept by the resident in their respective apartments, but shall not be kept, bred or used therein for any commercial purpose.
3. Dogs are not allowed on any common elements except in transit when carried or held on a leash.
4. Any household pet causing a nuisance or unreasonable disturbance to any other resident shall be permanently removed upon notice from the Board of Directors.
5. All pets shall be registered with the Resident Manager. Dog owners will supply a DNA sample for identification. The cost of the registration is $25 and will be paid by the resident. Any resident who fails to clean up their pet’s waste shall pay a fine of $100 for first offense and $200 for any subsequent offense
6. Household pets are limited to a total of two (2) pets per apartment; i.e. one dog, one
cat or two of either.

III. PARKING RULES
The following parking rules and regulations are to provide safety and orderly parking within The Moorings and to ensure sufficient availability of space for residents and their visiting guests. Parking on the sidewalk is strictly prohibited. No more than three authorized vehicles per unit may be authorized or permitted to park inside The Moorings without permission of the Board. All additional vehicles must be parked outside The Moorings. Owners of authorized vehicles must reside in The Moorings. If for over seven days an absentee owner or resident wishes to park a vehicle in his/her unit assigned stall or GUEST stall, that vehicle or vehicles will count toward any third vehicle allowance.
Assigned parking rules include:
1. All resident vehicles must be registered with the Resident Manager within 72 hours.
2. While the Board of Directors reserves the right to either approve or disapprove a vehicle to park within The Moorings, each authorized vehicle must display a current license, registration, safety inspection, and Moorings Parking Sticker.
3. All vehicles must be maintained in an orderly and presentable fashion consistent with the standards maintained by the Board of Directors and must be in a drivable condition at all times.
4. At any time, the Board of Directors has the authority to cancel a resident’s authorized vehicle parking privileges. Assigned parking space to accommodate two vehicles is provided for the exclusive use of each apartment. The third (3rd) vehicle may park in a guest stall.
5. The residents of any apartment must park their vehicles in the stall(s) assigned for the use of their apartment, except as provided elsewhere in the parking rules.
6. A vehicle is defined as a private passenger car, pickup, SUV, minivan or panel type truck, boat on a trailer or empty boat trailer.
7. A state registered recreational vehicle (RV) is not allowed.
8. A motorcycle/moped must be parked in their units’ assigned parking stall with another vehicle. A motorcycle or moped does not count as a unit 3rd vehicle.
9. 3rd Vehicle Boat Trailers may be parked in tandem guest stalls per registration and approval by Resident Manager.
10. Any vehicle authorized after February 10, 2010 must fit completely within the confines of its assigned parking stall.
11. Owners are responsible for the cleanup of any residue from their vehicles in parking lots or common areas. Cleaning method and agents must be approved by the resident manager.

Guest parking rules include:
a) For residents owning two vehicles per apartment, use of one guest stall is allowed during weekday and non-holiday daylight hours until 7 PM.
b) For those residents owning a third vehicle, use of one guest stall where available will be permitted. The guest stall, utilized for the resident’s third vehicle, should be in the same parking area and vicinity of the permanently assigned parking stall. If the unit's 3rd vehicle is absent for 24 hrs. or more, the remaining vehicles must use only their assigned stalls. There are 64 guest stalls in The Moorings, and with the exception of those stalls being used with permission as granted in the rules, parking stalls labeled “GUEST” should be used by the guest visiting The Moorings’ residents. Parking of guests vehicles is permitted in designated “GUEST” stalls for up to seven days for every thirty day period unless otherwise approved by the BOD.
c) All overnight guests shall display on their dashboard a completed GUEST PARKING PASS issued by the resident. Passes are available online or at the RM office. Guests agree to follow all House Rules and Regulations of the Moorings.
d) Guest vehicles are to be registered with the Resident Manager if they will be on the Moorings property for a period of time in excess of 72 hours.
e) Any violation of the parking rules and procedures by residents or guests may result in towing away the unauthorized parked vehicle at the owner’s expense.
f) By the authority of the Board of Directors, the Resident Manager may order the unauthorized parked vehicle towed away without notification of the owner or driver of such vehicle.
g) All vehicle towing will be at the expense and risk of the vehicle’s owner. The Moorings assumes no responsibility for any damage to any towed vehicle.
h) If a resident wishes to seek any exception to these parking rules, the resident must notify the Resident Manager in writing. The Resident Manager will bring the matter before the Board and then notify the resident of the Board of Directors’ decision.
i) PODS or any storage container shall not be placed on Moorings property without expressed written approval from Board of Directors.
j) If a resident receives more than 2 parking violations in a one month period or a cumulative total of 4 parking violations in 12 consecutive months, the resident may lose parking privileges for one (1) month.

IV. POOL AND RECREATION CENTER RULES
The Moorings Association of Apartment Owners does not accept any responsibility for any injuries or damages sustained by the users of the pool or recreation center. Anyone using the pool or the recreation center does so entirely at their own risk.
POOL RULES
A. Swimming pool hours:
1. 6:00 A.M. to 10:00 P.M. all year for adults 18 years of age and older.
2. 8:00 A.M. To 8:00 P.M. for children.
B. Each resident may have up to 4 guests at the pool and must accompany their guests at all times in the pool area. Guests who are registered with the Resident Manager do not have to be accompanied by their host resident.
C. Reservations for a pool side swimming party may be made in writing in advance with the Resident Manager. The pool area may be reserved only on weekdays between 8:00 A.M. and 4:00 P.M. and will be limited to a two hour maximum.
D. Specific rules governing pool use are posted at the pool side for handy reference and include:
1. Children under the age of 10 must be accompanied by an adult in the pool area, and children between the ages of 10 to 14 years of age must have a buddy swimmer with them. Running, jumping, bicycle riding, skateboarding, scooters, horseplay, throwing of balls, undue noise, etc. are prohibited in the pool area.
2. Swimming aids and kick boards are permitted in the pool. Items such as inflatable devices, surfboards, and metal articles including hairpins are not allowed in the pool or pool area.
3. Litter must be disposed of in the receptacles provided in the pool area. 3. SMOKING is prohibited in the pool area.
4. Animals are prohibited in the swimming pool area.
5. No GLASS of any kind is permitted in the pool area.
6. Prior to entering the pool, remove all suntan oil and sand from swim suits by utilizing the showers located in the pool area.
7. Good health rules should be observed. If your body requires Band-Aids, etc. do not use the pool. Do not dispose of baby diapers, etc. in the garbage receptacles in the pool area.
8. Children in diapers are not allowed in pool without “swim pants”.

RECREATION CENTER RULES
A. The Recreation Center shall be for the exclusive use of residents and their guests when in the company of the resident. Apartment owners who rent their units are considered to have rented their privilege to use the pool and Recreation Center as well.
B. The Recreation Center and BBQ area may be reserved for private parties on a first come, first serve basis by making advance arrangements in writing with the Resident Manager. The Resident Manager will collect a $50.00 check deposit made payable to The Moorings with a completed Rec Center Reservation form prior to the scheduled use. The deposit will be refunded to the resident after the Resident Manager has determined that there has been no damage to the premises, and the facility is adequately cleaned. If the deposit is not sufficient to cover any damages to the facility or premises, the Board of Directors will assess additional costs from the resident per the Resident Manager’s recommendations. No future reservations may be made by the resident in violation if previous cleaning and or damage bills are not paid by the resident utilizing the facility.
C. Residents utilizing the Recreation Center are responsible for the conduct of their (EMAIL HIDDEN)plaints by other residents regarding your guests may jeopardize your future use of the Recreation Center.
D. The Recreation Center may be reserved seven (7) days a week. Please note that this does not include use of the pool. Since utilization of the Recreation Center requires observation of the “hours of quiet”, Guests must vacate the Recreation Center no later than 11:00 P.M., are not allowed to loiter in the parking areas or common elements of The Moorings, and must quietly exit The Moorings property in an orderly fashion no later than the beginning of “Quiet Hours”.
The basketball area at the Recreation Center shall be used at the residents’ own risk. For the comfort & safety of all residents, playing at this site should be limited to daylight hours.
Special Note Concerning the Recreation Center:
Teenage parties will require a $100 deposit and a complete guest list provided to the resident adult host who will supervise the party at all times. The guest host will provide the Resident Manager with the complete guest listing 48 hours prior to the party. In addition, teenage parties exceeding thirty five (35) guests will require a security guard to be present at the party at the expense of the resident host. The deposit, complete guest list, and name of the security guard must be provided to the Resident Manager 48 hours prior to the party.
NOTE:
Section (PHONE NUMBER HIDDEN) H.R.S. was enacted into law on May 18, 1984 and makes it a criminal misdemeanor (3 years in jail and $1.000 fine) for an adult to knowingly permit minors to possess intoxicating liquor while on property under your control, or provide intoxicating liquor, via any means, to a minor on property under such person’s control.

V. BOATS
All boat mooring applications will be granted only to boats wholly owned by one or more residents of The Moorings. Residents desiring to dock or attach a boat to the stone wall or boat docks attached to the common elements of The Moorings may do so only after receiving written permission from the Board of Directors. The resident requesting docking privileges must present to the Board of Directors all updated licenses and marina permits. The Board of Directors reserves the right to cancel any boat docking privileges at any time. Under no circumstances shall any resident dock or attach more than ONE boat to The Moorings common elements per unit. All boats must be maintained in an orderly and presentable fashion consistent with the standards set by the Board of Directors. All boats must be in an operable condition at all times. All boats are to be used for personal use. No commercial boats shall be docked at The Moorings. The length of the boat may not exceed 19 feet LOA (length over all) without the approval of the Board of Directors.
Note: Addendum C (Page 18) contains this definition of boat LOA.
“For any boat longer than 19 feet LOA (including any exterior appendages such as outboard motor, swim step, pulpit, bowsprit etc.)”
VI. KAYAKS/ONE-MAN CANOES
1. Kayaks, Stand Up Paddleboards (SUP’s) or one-man canoes will be stored neatly at the unit side of the dock in order to provide a safe, free pedestrian access across all boat docks.
2. No more than two (2) kayaks or one-man canoes may be stored on an owner’s boat dock. Additional kayaks/one-man canoes may be stored in the Moorings-provided racks or places off the dock, i.e. under deck, etc.
3. The Moorings AOAO will provide a rack to store kayaks/one-man canoes in the Common Area.
4. One-man outrigger canoes must be stored with the outrigger detached from the boat or secured so as not to impede passage along the docks.

VII. DOCKS
The Moorings Board may give permission, upon written request from an owner, to build a boat dock on the limited common elements behind their unit.
Failure to provide a safe, free pedestrian access to your dock or properly store your SUP’s, kayak/one-man canoe(s) will result in a fine.
Owners that do not have limited common elements behind their unit or are not on the waterfront (1-6) may apply to the Board of Directors to build a boat dock in another area of The Moorings.
An approved plan for Cantilever boat docks is available at the Manager’s office and in Addendum D.
a) All boat docks built must comply with these approved plans. Owners are responsible for the appearance and the maintenance of their docks. The Army Corps of Engineers regulations state that no dock & boat shall be wider than 10 feet from the seawall in those areas that are designated with a diamond, on the Hawaii Kai Marina Rules and Regulations, Exhibit “C”. (See Moorings Addendum “C”)
b) Those docks that are in a wider marina area, designated by a rectangle, have permission to be a total of 25 feet from the seawall. Check with the Hawaii Kai Marina Association for a more detailed description of these requirements.
Steps to build a boat dock:
1. Obtain a copy of the approved Cantilever boat dock plan (Addendum D) from the Resident Manager or Moorings Website for review.
2. Develop and document your plans.
3. Submit your written request to build your boat dock with plans attached to the Resident Manager who will review and forward it on to the Board of Directors. (Use Moorings Renovations Form - Addendum “A” attached hereto.)
4. Upon written Board approval, you must submit your request and Moorings Board approval to the Hawaii Kai Marina office who will forward your request to the Corps of Engineers.
5. Upon approval from the Corp. of Engineers, you may proceed to build your dock.
NOTE: Any deviations from the approved plans will require additional Board approval

VIII. ENFORCEMENT OF THE RULES/FINING SYSTEM
Residents, whether owners or renters, are subject to the rules and regulations contained in the following:
Declaration of Horizontal Property Regime
Bylaws of the Association of Apartment Owners
House Rules
Condominium Property Act - (Hawaii Revised Statutes 514B)
Such rules and regulations, including all amendments, changes and additions, are needed to ensure the proper use and enjoyment of all facilities in the Moorings for all residents. It is the Board of Directors’ policy to enforce the above rules without exception.
It is the duty of the Resident Manager to enforce the rules and regulations. Residents or authorized guests who observe violations of these rules and regulations should bring the violation incident to the attention of the Resident Manager. Violation of the rules and regulations will be handled as follows:
1. The Resident Manager and the Managing Agent are authorized by the Association of Apartment Owners Board of Directors to demand that persons violating these House Rules cease such violations and/or vacate any common or limited common element immediately. Non-compliance with verbal demands from the Resident Manager or Managing Agent could result in permanent eviction from the property or a monetary fine assessed to the owner’s account.
2. Complaints from owners must be in writing and addressed to the Board of Directors c/o the Managing Agent. Owners can address the Board of Directors in person with complaints but only after notifying the Managing Agent one week prior to a scheduled Board of Directors meeting.
3. Citations can be issued to Owners/Residents for violating any of these House Rules. The Board of Directors has approved authority to levy monetary fines to an owner’s account for repeated infractions of these House Rules or damages to common/limited common areas/elements by Owners/Residents. Owners shall be responsible for any and all House Rule violations by their tenants.
4. All notifications of violations will be distributed to the Unit File, the Resident, and the Owner and/or Agent if the owner is not the Resident.

5. The following citations/fines can be given or assessed to Owners/Residents for violations of House Rules.
a) 1st Violation – a verbal reminder given by the Resident Manager or Managing Agent to the offender.
b) 2nd Violation – a written notice to the unit owner and the person(s) violating the same House Rule or By-Law.
c) 3rd Violation – a written citation given to the person(s) violating the same House Rule or By-Law as was referenced in previous verbal and subsequent written notifications and a $25 fine is assessed to the owner’s account.
d) 4th Violation – a written citation given to the person(s) violating the same House Rule or By-Law as was referenced in previous written citation and subsequent fine and a $50 fine is assessed to the owner’s account.
e) 5th Violation – a $100 fine is assessed to the owner's account
f) 6th Violation – a $200 fine is assessed to the owner’s account
g) 7th Violation – a $350 fine is assessed to the owner’s account and the Association’s Attorney may be instructed to issue a demand letter to cease and desist activity causing repeated violations of the same House Rule or By-Law.

Any violations of the House Rules will revert back to the 1st Violation Procedure after a period of 365 days from the latest violation of the same rule.

DANGEROUS ACTS MAY INCLUDE BUT ARE NOT LIMITED TO STARTING A FIRE, INFLICTING BODILY INJURY ON ANOTHER PERSON OR COMMUNICATING THREATS TO PERSONS AND/OR COMITTING A PREMEDITATED ACT OF DESTRUCTION TO ANOTHER PERSON’S PROPERTY.
FLAGRANT VIOLATIONS INCLUDE BUT ARE NOT LIMITED TO RENTING UNITS FOR LESS THAN 30 DAYS, AND THOSE FINES MAY BE ASSESSED ON A DAILY BASIS.
ALL LEGAL COSTS INCURRED BY THE ASSOCIATION TO REMEDY OR RESOLVE REPEATED VIOLATIONS OF THE HOUSE RULES OR BY-LAWS OR TO RESOLVE DISPUTES BETWEEN THE ASSOCIATION AND OWNERS/RESIDENTS OR DISPUTES BETWEEN RESIDENTS WILL BE THE RESPONSIBILITY OF THE OWNER/RESIDENT WHO CREATED THE DISPUTE.

APPEALS
Appeals or disputes from Owners must be in writing and addressed to the Board of Directors c/o the Managing Agent. The Managing Agent will present the written appeal/dispute to the Board at the next scheduled meeting of the Board of Directors.

Owners can appear before the Board to address appeals/disputes at a scheduled Board of Directors meeting. The Owner must first notify the Managing Agent one week prior to a scheduled meeting to appear before the Board of Directors
Tenants who may have a dispute or wish to appeal a citation issued to them must first discuss the issue with the owner of their unit. The owner must then submit in writing to the Board of Director c/o the Managing Agent, a request to allow his/her tenant to appear before the Board of Directors to dispute or appeal a citation.
Written requests must contain specific dates/times and all pertinent facts of the disputed citation. The Managing Agent will notify the owner and tenant in writing of the Board decision within thirty (30) days of receiving a request to appear before the Board.
Any person appearing before the Board of Directors will have ten (10) minutes to state their dispute or appeal. The Board will notify those who appear before the Board of their decision in writing via the Managing Agent. The Board’s written response is the final decision.
Any further appeal of the Board of Directors’ decision will be in accordance with HRS 514B – 161 (Mediation or “Condo Court”)

IX. RENOVATIONS
Residents are prohibited from making any structural changes to the privacy areas, limited common areas, external or internal portions of their units without the prior written approval of the Board of Directors (signed Addendum A).
All new exterior sliding door and window frames must match the current bronze color.
All window, slider and door screen material shall be black or bronze.
Exterior sides of all non-glass louvers shall be either the color of the trim on the building or dark brown.
Glass louvers be either uncolored or smoked and it is suggested that they be opaque.
All lanai decks shall be trim color or dark (Moorings) brown.
All docks shall be dark brown.
Rain gutters shall be trim color
The Moorings: Unit Renovations Procedure
The Board of Directors (BOD) requires this Procedure to be followed for owners requesting unit renovations/remodeling. You will receive written notification from the BOD about your request.
Before any Renovation approval:
1. Present a preliminary plan of the proposed changes to the Resident Manager for review.
2. Obtain a copy of the building complex floor plans from the Resident Manager.
3. Formulate written plans and specifications to scale including detailed plot plans prepared by a licensed architect or contractor if so required by the BOD.
4. Submit The Moorings Renovation Form (Addendum “A”), architectural plans, requested start date and approximate finish date, specifications and necessary building permits to the BOD for approval to ensure City & County building requirements and The Moorings existing Rules & Regulations are met.
After Board of Directors written approval:
1. Arrange work schedule with neighbors, informing them of work dates and type of work to be done daily (i.e. any loud noises such as drilling, cement sanding, and hammering so the neighbors may make arrangements to be elsewhere).
2. According to state law, work is not permitted on Sundays and Holidays.
3. Please be courteous to your neighbors by scheduling construction noise between 8AM and 5PM.
4. Parking for contractors and/or deliveries must be planned in advance so as not to disturb your neighbors.

5. If there are any changes to your submitted construction plans, modified plans must be re-submitted for re-approval from the BOD.
6. Minimal construction waste (less than one cubic yard) can be put in the dumpster. Your own waste company must haul off construction debris that produces a large and/or a heavy amount of waste. Many owners have contracted for a private dumpster to be used. Violation of this rule will result in an immediate $250 fine.
7. Construction clean-up is the owner’s responsibility and must be done daily.

Skylights, Solar Panels and Attic Fans:
After BOD approval and before installation, Tropical Roofing and Raingutter, Inc. must be notified by the owner to inspect and approve the completed work. Current cost per unit is $150 paid by owner. This approval is needed to maintain The Moorings’ roof warranty.
Back Lanais/Decks:
A. Enclosing back lanais and extending decks need the written permission of the owners on both sides of your unit. (Once issued, and construction has begun, that permission cannot be rescinded).
B. Complete the approval section on the renovation form before giving the paperwork to the Resident Manager.
C. Owners are responsible for the integrity of their construction work. Any damages to your neighbors’ property that occur from your construction work will be your financial responsibility.
D. Unit owner must maintain any owner changes to Limited Common Elements.
Boat Docks:
A. Boat docks must have Marina approval. The Resident Manager has plans for lanais/decks and cantilever boat docks for your use.
B. Any new or reconstructed boat docks shall extend to the property line.
C. Owners are responsible for the integrity of their construction work. Any damages to your neighbors’ property that occur from your construction work will be your financial responsibility.
The Board of Directors will review all proposed plans and determine the suitability of the plans in meeting the aesthetic guidelines established for The Moorings. After review, the Board of Directors will issue written notification of its decision.
NO renovations shall be started without the written approval of the Board of Directors.

ADDENDUM “D”
Boat Dock Guidelines
1. The primary responsibility of the Moorings Board of Directors is to insure SAFETY of the residents and guests on the property. Other responsibilities include the general appearance of the complex. In order to enhance the aesthetics of the waterside portions of the complex, the following guidelines for cantilever docks will be adopted. In no way will these guidelines for dock appearance impact or contradict the actual structural requirements of the dock construction. Those requirements are the responsibility of the dock builder and/or owner of the unit.
2. All new dock construction, dock repairs or dock replacements shall have a completed and approved Addendum A on file with the Resident Manager PRIOR to any work being started. This requirement does NOT apply to painting or loose board re-securing.
3. New, replacement or repaired docks shall be constructed to meet the adjacent docks if present or extend to the property lines of the unit if there is no adjacent dock.
4. Dock skirt boards and vertical and support structures shall be painted “Moorings Brown” or be constructed of Dark Brown Trex or equivalent.
5. Horizontal dock surface shall be “Moorings Brown” or Dark Brown Trex or equivalent.
6. One ladder may be attached to the dock. It shall be stainless steel, Trex, or painted wood (Dark Brown)
