SHORT TERM RENTAL AGREEMENT
This Short Term Rental Agreement (the “Agreement”) is an agreement made by and between _________________________ (“Rental Agent”) and ________________________ (“Guest”) as of __________, the date of booking. The Guest has agreed to rent the residence described below (the “Property”), for the duration of the Rental Term and for the Rental Fee stated.
1. Property: The Property is located at: ______________________________________¬¬_______
2. Rental Term: The lease begins at 3:00 p.m. on ____________ (the “Check-in Date”) and ends at 10:00 a.m. on ____________ (the “Checkout Date”) and is reserved for ¬___ guests.
3. Rental Party: Guest agrees that no more than ___________ persons shall be permitted to stay overnight at the Property during the Rental Term. Guest agrees to cause all members of the rental party and anyone else Guest permits on the Property to comply with the conditions and restrictions imposed upon Guest under this Agreement.
4. Rental Fee: The Rental Fee for the Rental Term of the Property is ____________, payable according to Airbnb policy.
5. Security Deposit: Guest is liable through Airbnb for a security deposit in the amount of $500.00. No claims shall be made against this amount unless during Guest’s Rental Term there are:
a. damages to the Property or furnishings
b. dirt or other mess requiring excessive cleaning
c. above normal costs incurred by Rental Agent due to Guest’s stay
d. costs to Rental Agent due to violation of this Rental Agreement by Guest
6. Cancellation Policy: Cancellation rules will follow the strict policy of Airbnb:
If Guest pays the full balance on time, they receive a 50% refund up until 1 week prior to arrival, except Airbnb fees.
Early departure does not warrant any refund of Rental Fee.
7. Condition of The Property: The Property is provided in “as is” condition. Rental Agent shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, cable TV, fireplaces and appliances. Rental Agent shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible.
8. Use of the Property: Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. Guest and their permitted guests shall refrain from excessively loud noise and shall not disturb, endanger, or inconvenience neighbors, nor shall Guest use the Property for any unlawful purposes.
9. Entry and Inspection: Rental Agent reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property. If Rental Agent has a reasonable belief that there is imminent danger to any person or property, Rental Agent may enter the Property without advance notice.
10. Risk of Loss: Guest agrees that all personal property and other items brought into the Property by Guest or their permitted guests shall be at the sole risk of Guest with regard to any theft, damage, destruction or other loss and Rental Agent shall not be responsible or liable for any such loss.
11. Release: Guest hereby waives and releases any claims against Rental Agent, the Property owner(s) and their successors for any personal injuries or loss of life that may be sustained by Guest, their permitted guests or visitors on or about the Property. Guest acknowledges that any part of the Property or its amenities may be potentially dangerous and involve potential risks when used, particularly with regard to children, and such use is at the Guest’s own risk and responsibility.
12. Falsified Reservations: Any reservation obtained under false pretense will be subject to forfeiture of the Rental Fee, and the party will not be permitted to check in.
13. Additional Terms: Guest further agrees to the following additional terms and conditions:
a. Check-in time is 3:00 pm (MST) and Checkout time is 10:00 am (MST). Early check-ins or late check-outs are not allowed without permission from Rental Agent. Late fees will accrue at the rate of $50 per half hour past Checkout time starting at 10:30 am. A full day will be charged after 12 pm.
b. No smoking of any kind is allowed on the property. This includes cigarettes, pipes, cigars, marijuana, and vaporizers.
c. No pets are permitted at the property at any time and under any conditions.
d. Age requirement: The Primary renter must be at least 25 years old.
e. Housekeeping: There is no daily housekeeping service. The Rental Fee includes a one-time linen-towel setup. Towels, linens, flatware, or other household items are not permitted to be taken from the Property.
14. General Provisions: This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments or modifications to it shall be void unless the same are in writing and signed by both the Guest and the Rental Agent. This Agreement shall be governed by the laws of the State of Colorado.
15. Signatures: A booked reservation by Guest shall constitute the same as the signing of this Agreement by Guest and Rental Agent and the commitment of both parties to comply with the terms and conditions set forth in this Agreement.
