In the event of any problems whatsoever, the total liability of Andrew & Joanna Hinds will be limited to the rental amount paid by the client.
The owners accept no responsibility whatsoever for any accidents that occur in the apartment, or on the steps leading up to it, or on the balcony. The Lead Name on the booking form is responsible for the safety and well-being of their guests.
We ask guests to be careful to ensure the fire in the lounge is not left on when either outside or going to sleep. We also ask that they are careful with the tiled floors in both bathrooms. We do not accept any liability for injury or damage caused here. We also ask that when driving to the parking area at rear of property that guests drive very carefully. Your insurance would have to cover any wall damages which might result, so please take care here.
You can leave property either through our own independent large front door, down path (North) towards High Street. If accessing the garage at the rear you may use the kitchen door and garden gate at rear before continuing towards the rear car park. You can cross the grass and garden area at the rear (belonging to apts. 2 and 3) and use the rear pathway (upwards to South)to access our garage. Please return by the same route, or, after visiting garage (where supplies are stored), you may choose to go onwards to your car from the garage or to St. Andrews street. Please do not exit the kitchen door and rear gate to then turn left to go towards the front of the building as this route passes our neighbours’ properties and land.There is no right of way to exit the property through the front gate (on eastern and right hand side).
We try to ensure photos and descriptions are as accurate as possible and up to date, but they should be used as a guide only.
Neighbours: As there are three flats within the large house conversion, of which we are the large Ground Floor one, (the other flats have separate front door arrangements away to the east side of the property), we cannot be held responsible in the event of any excessive noise or disturbance from above. We respectfully ask that all our guests and clients repay the neighbourly courtesy of limiting noise to prevent disturbances wherever possible.
Our property is managed Gordon Davie. All breakages, accidents, problems and losses must be reported to him, so that they can be attended to.
Home appliances will from time to time malfunction and may need repair. We will use our best endeavors to have any problem rectified as quickly as possible. Access to the property may be required by authorized personnel during your stay but they will try and keep any inconvenience to a minimum. Where possible, they will try to give prior notice.
Should a cancellation be necessary by the client, then your deposit will not be returned. Should a cancellation occur after the total balance has been paid, we will make every attempt to re-let the accommodation and will immediately make the dates available. Should we be successful in re-letting, we will refund any monies due to you, less an administration charge which would be in addition to your initial deposit. In the event of cancellation, your security breakages deposit [if paid] will be returned to you. Should we be unable to re-let, then the charges below will apply:
If 40 days or more till your holiday = Deposit; If 28 – 41 days, then 50% of total cost
If 27 – 14 days then 75% of total cost. If Less than 14 days till holiday, then 100%
We strongly advise you to take out holiday travel insurance as soon as your booking has been confirmed. This should cover any cancellation for reasons beyond your control.
We reserve the right to cancel any reservation when this is due to circumstances beyond our control. Such circumstances include, but not limited to, failure of equipment, loss of water supply, electricity, adverse weather conditions, threat of war, riot, industrial disputes etc. All monies shall be returned in such circumstances. If a client does not pay the full balance when it becomes due, then we reserve the right to cancel your booking and retain your deposit.
A party is not liable for failure to perform the party’s obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, volcano, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service. No party is entitled to terminate this Agreement under Termination above in such circumstances. If Force Majeure is asserted as an excuse for failure to perform the party's obligation, then the nonperforming party must prove that the party took reasonable steps to minimize delay or damages caused by foreseeable events, that the party substantially fulfilled all non-excused obligations, and that the other party was timely notified of the likelihood or actual occurrence of an event described in the Force Majeure Clause above.
The property is only allowed to be occupied by members specified on the booking form, unless agreed by prior arrangement. Under no circumstances, should the villa/apartment sleep more than the maximum occupancy level. This is for your health and safety and in the unlikely event of a fire.
Respect for Neighbours:
We ask that noise levels are kept to a minimum. Marine Lodge has three apartments. We ask you to respect your neighbours , those in apartments above. Please do not use or walk upon any of the grass/ land to the right or left of Marine Lodge beyond the building walls, or in front / through Wallace & Menzies solicitors. You may walk on the garden within the building walls themselves.).
We reserve the right to remove you from the property, if you are found to be causing unacceptable noise levels and disturbing the peace.
We may choose to obtain a refundable security deposit of £200 1 week before the start of the holiday. This guards against any damage to the property during your stay. The security deposit will be returned to you less any damage or breakages done by you or your party. You will be held responsible for any breakages or damage to the property and its contents. In the event of such occurrence the incident must be reported to the property representative, myself or noted in the breakages book. A full inventory check will be made following your departure, and if all is satisfactory, your security deposit will be returned to you soon after your departure.
Bedding/ Towels: Clients should be aware of 2 key points to do with bedding and towels:-
1. If extra bedding and towels are used ... we reserve a right to charge for its usage (as we are charged for extra laundry).
2. If bedding or towels are marked or stained in any way which is not removeable through usual laundry washing, or deeply ingrained to make removal unlikely/ impossible between stays, we reserve right to charge for the cost of replacement. This may extend to towels and bedding, linen towels and mattress protectors and duvets as well as pillows. Example: Certain Sun Tan Creams / false tan / suntan enhancers can permanently damage sheets etc..
The lead name on the booking form agrees to accept full liability for all loss/damages to the property or its contents caused by any other member of their party and confirms that full cost of repair/replacement will be met.
We want our apartment, to be a totally smoke-free zone. If the agent, when she comes to clean after departure, is of the opinion that smoking has taken place, the cost of cleaning will be forfeited from your security deposit. Strong chemicals need to be used to get rid of the smell, so it could be costly.
Please use heating from boiler and hot water with care. Please keep the timer switch on when heating needed. Please do not use units continuously or whilst the property is unoccupied. Excessive use could incur a charge. Please do not leave the heater in bathroom on if you decide to use.
Return of Keys:
All sets of keys upon departure should either be left in white box at front in porch or returned to Torquil in person. Any keys inadvertently retained, should be posted to Andrew Hinds at Address at foot.
Any building work which may commence in the local vicinity of the property is outside of our control and we cannot be held responsible for any disturbance.
All bed linen and towels are provided with all properties and the property will be cleaned for your arrival. Mid-let cleans can be arranged at your request, and paid locally to the management company.
Cleanliness: The apartment should be clean and ready for you upon arrival. If you believe it is not, then please inform me or Gordon as soon as possible. (preferably upon arrival).
For bookings made more than 8 weeks prior to arrival a 30% deposit of the accommodation rental is required. The balance will be payable 8 weeks before your arrival. For bookings made less than 8 weeks before arrival total payment will be required on booking. Payments can be made by cheque or Bank Transfer. Our bank account details can be found on the booking form.
Check In / Check-Out.
In: After 4pm. Out: Before 11am. (Unless otherwise agreed)
Care Hire/Airport Transfers/ Parking Space: You may choose to make these arrangements. Please advise travel detail on booking form. We have a dedicated parking space to the rear of Marine Lodge.
