- At the cabin is a "Welcome Binder" with additional instructions for your arrival and departure. Check in time is any time after 4pm on the day of your arrival to allow for the cleaning of the cabin after the previous guest. Check-out is by 11 am or earlier to also allow for the cleaning service to have enough time to clean. No pets or smoking is allowed.
SHORT TERM RENTAL AGREEMENT
Dear Renter, Thank you for choosing our cozy cabin home for your vacation. We hope that you have a pleasant stay.
This Short Term Rental Agreement (the “Agreement”) is made by and between Mark and Odalys Sage (“Homeowner”) and Your Party (“Guest”), as specified in the corresponding website, and as of the date last set forth on the corresponding website. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:
By booking Songbird Mountain Cabin, Guest is agreeing to the terms and conditions within this rental agreement.
The property is located at: 309 Scataway Road, Hiawassee, GA 30546
Your confirmation is as follows: Check-in time is after 4:00 pm EST (No early check-in) Check-out time by 11:00 am EST Number of adults: not to exceed 4. Number of children: not to exceed 4. Pets: No pets are allowed, no exceptions.
Your full payment is due with this signed lease by the selected and approved method.
Rental rate and fees are as follows:
Rates are specified in the corresponding website. There is a $125 cleaning fee per stay. A 12% tax is included in all rental prices. Our listing website also charges a service fee as specified in the on-line quote. This fee is payable by the guest. If you use the service of , they charge a 2.9% (3.9% for international transfers) convenience fee, which is paid by the guest. Additionally, a $500 security deposit is maintained by Airbnb using their most current rules.
The Inventory list at the end of this document is in the contract so that you can see what items are at the cabin to aid in your packing and travel plans. A few days prior to your stay, we will provide instructions for entry to the property.

1. Property. The property is located at:
309 Scataway Road, Hiawassee, GA 30546
The property is furnished and includes all items listed on the Inventory Sheet (attached)
2. Rental Party: The rental party shall consist of Guest and the number of persons identified on the website at time of booking. The maximum number of guests is limited to the approved number of persons for the duration of the stay. Additional overnight guest(s) must be approved by the Homeowners before arrival.
3. Term of the Lease. The timeframe of the lease is specified in the website agreement.
4. Minimum Stay: This property requires a 2-day minimum stay. Longer minimum stays may be required during holiday or specific special periods.
5. Rental Rules: Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the property and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules as well as posted rules on site at all times while at the property.
6. Access: Guest shall allow Homeowner access to the property for purposes of repair and inspection. Homeowner shall exercise this right of access in a reasonable manner.
7. Rental Rate and Fees
a. Reservation: The property will be held for the above-mentioned dates for 4 business days from the forwarding of this rental agreement.
b. Full Payment: this contract requires full payment as specified on page 1 via (2.9% fee required, or 3.9% if international transfer) or other deemed acceptable payment to both parties.

Security Deposit: The deposit is for security and shall be refunded within 30 days of the Checkout Date provided no deductions are made due to:
i. damage to the property or furnishings;
ii. dirt or other mess requiring excessive cleaning; or
iii. any other cost incurred by Homeowner due to Guest’s stay.
iv. Dishes must be washed, dried, and put away to avoid additional cleaning charge.
v. Additional charges for cleaning may apply if deemed necessary by the cleaning company for extra messy conditions.
If the premises appear dirty or damaged upon Check-in, Guest shall inform Homeowner immediately.
8. Cancellation Policy: If Guest wishes to cancel his/her reservation, the cancellation must be in writing and received by Homeowner per the guidelines below. The payment will be refunded as follows:
75% if canceled 60 days prior to the Check-in Date
50% if canceled 30 days prior to the Check-in Date
9. Insurance: We encourage all renters to purchase traveler insurance.
10. Payment: Acceptable payment methods are a bank transfer, cashier’s check or (2.9% fee, 3.9% for international transfers).

Exhibit A
RENTAL RULES
1. Smoking is NOT allowed inside home or decks. Smoking is allowed outside only away from the home. Dispose of any cigarette butts appropriately and safely.
2. People other than those in the Guest party set forth above may not stay overnight in the property without prior approval from the Homeowners. Any other person in the property is the sole responsibility of Guest.
3. This home is privately owned; the owners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
4. Keep the property and all furnishings in good order. Use common sense. For example, if your shoes are covered in mud, do not walk through the whole home. If excessive cleaning is required it will be deducted from the security deposit. Remote controls shall be placed near device upon departure.
5. Only use appliances for their intended uses.
6. Pets are NOT allowed.
7. Parking:
Parking is limited to two vehicles. The use of your car’s emergency brake and appropriate front wheel turning is recommended while parked. At entry to driveway it is recommended to use your vehicle’s lower gear, first gear. The metal gate at the driveway’s entrance should be closed and relocked upon departure. The gate lock code is stated in your Welcome Email.
8. Housekeeping: There is no daily housekeeping service. While linens and bath towels are included in the unit, daily maid service is not included in the rental rate. We do not permit towels or linens to be taken from the unit. The Guest will be responsible for cleaning the dryer filter after each use so as to avoid the fire hazard.
All trash must be bagged in white kitchen garbage bags. Once the kitchen trash container is full, place in outside trashcan. The outside trashcan has two safety clips on top to keep out critters. Press down on the clips properly to open the clips. Do not put open the clips by breaking the clasps. Only place bagged trash in this can; no loose trash is permitted.
The need for excessive housekeeping upon departure will be deducted from the security deposit.
9. Water and Septic Upon arrival, the water to the home can be turned on by turning the yellow valve within the small white pump house on the right hand side of the driveway, approximately 100 feet from the cabin’s front door. If needed, there is a secondary water valve shutoff under the kitchen sink.
DO NOT FLUSH anything other than toilet paper. No feminine products should be flushed at anytime. If it is found that feminine products have been flushed and clog the sewage system, you could be charged damages. The kitchen sink does not contain a garbage disposal. Place any solid waste from the sink strainer in the kitchen trash.
10. Hot tub: Hot tub rules are posted outside close to the hot tub. Responsible adult supervision is ALWAYS required. The hot tub cover is locked in place with 1 clip on each side and a steel cable across the top cover. The steel cable must be unlocked to gain access. The combination to the hot tub lock is specified in the “Welcome Binder”. The hot tub rules are inserted here for your review.
Hot Tub Instructions and Requirements
Use of the hot tub is at your own risk. Note that some surfaces near the spa are slippery. A step stool is provided to aid in your entry and exit of the tub. The maximum bathing load is 4 persons. A responsible adult must be present at any time the hot tub is accessible. Bathers must shower before entering.
Fully remove cover prior to usage. Always secure cover after each use for safety.
Do not exceed maximum water temperature of 104 degrees Fahrenheit. Do not exceed 15 minutes of use at that temperature. A more comfortable temperature may be approximately 96 degrees Fahrenheit. Do not use any glass bottles or cups in or near the
hot tub. Use plastic cups only. No food or animals are allowed in the hot tub. No jumping or diving is permitted.
Pregnant women, small children, people with health problems and people using alcohol, narcotics or other drugs that may cause drowsiness should not use the spa without first consulting a doctor.
Do not urinate in the hot tub. The bathroom is steps away. No infants or diapers are allowed in the hot tub.
Return hot tub’s temperature to 80 degrees F on your departure. Lock the cover in place using the clips, cable and lock provided.
11. Fireplace: The fireplace in the home is for aesthetic or thermal use. Its use is not allowed during the summer months as it will overheat the home. Rules for its use are posted next to the fireplace and are restated below:
Fireplace Instructions: Clean out ashes from previous fire using the tools provided. Make sure both flue vents are open. At top of edge of the metal curtain, move the horizontal lever to the right position. At the left hand side of the curtain, move the vertical lever into the down position.
NEVER use accelerants such as gasoline or lighter fluid. Place a prepackaged starter log on the metal rack in the fireplace. An additional dry natural hardwood log may be added to extend the fire. Do not use wet or softwood logs such as pine. Use a match or lighter to light the paper around the prepackaged log in the middle and at each end. Keep the metal screen closed after the fire has been started.
Use the provided fireplace tools as needed to maintain a safe configuration of logs. Do not allow logs to roll out of the fireplace. The flues must remain open until the fire is completely out including ANY burning embers. A small amount of sand may be used to help extinguish the fire. Do not use water. In case of emergency, a fire extinguisher is located in the lower kitchen cabinet and another in the laundry area.
Any damage caused through misuse of the fireplace will be the financial responsibility of the rental party.
12. Rental of cabin: The minimum rental is stated on page 2 of this contract.
13. Number of renters: The number of renters and renter’s overnight guests who are not in residence may not exceed two adults per bedroom. Any exception requires approval of the unit owner.
14. Noise: Please be considerate of others/ neighbors. Sound from all radios, tvs, stereo equipment, etc. should not be audible from outside the unit.
15. Wildlife: All wildlife should be respected and protected as each species serves a purpose in our environment. Do not chase, catch or harm any wild animals.
16. Pest Control or Lawn Maintenance: A pest control or lawn maintenance service may arrive on any given day to service the home. Please allow them access to all outside areas and follow any instructions that the service may ask of you for your safety.
ACKNOWLEDGMENT: By completing this booking, the Guest is stating that they have read and agree to abide by the above Rules and Regulations.

Absolutely amazing! The house was the perfect quiet getaway we wanted within driving distance of all the hiking and sight seeing that you could imagine. I can not say enough how wonderful of a host Odalys's was! She responded very quickly every time, which was multiple times. Highly recommended to anyone.

Songbird Mountain Cabin was amazing. The view was better than what it shows on the pictures. You are far enough up in the mountains to get away from the hustle and bustle of everyday life to enjoy nature and relax but you're not too far away to have to drive an hour away to get to a store or enjoy outdoor activities! The hot tub was perfect at night and it was super easy to start up and shut down when we were finished. Don't even get me started on the mattress and bed sheets... OMG! The most comfortable bed and softest sheets I've ever slept on! You will not be disappointed when you stay here. My boyfriend and I are already planning our trip back!

My sisters and my mom reunited at this beautiful, rustic mountain cabin! We loved the views and the jacuzzi! We also went to Helen and explored the area! We would totally go back! It's about 2 hours outside of Athens, where my family lives, so it was a quick drive, which was a huge plus!

This place was absolutely gorgeous!! After looking at the pictures online, I fell in love and immediately booked. When we showed up, the place was better than I imagined it to be. It was decorated so cute and it was so quiet. Everything about this cabin was perfect. My husband and I enjoyed spending our first anniversary here and plan to come back for the next couple of anniversaries. Thank you so much for opening your cabin up to us!
